ANNOUNCEMENT: HELLENIC POST COLLECTIVE EMPLOYMENT AGREEMENT 2013-2014

The signing of the HELLENIC POST Collective Employment Agreement on Monday, June 10th 2013 completed the most important item in P.O.S.T.’s action plan, as had been decided by the competent bodies of the movement.

The signing of the HELLENIC POST Collective Employment Agreement 2013-2014 at a time most crucial for the future of the HELLENIC POST and its employees, means that a new, more positive framework is now in place.

With the signing of the HELLENIC POST Collective Employment Agreement 2013-2014 we achieved the establishment of a program of immediate actions, that aim to secure the income of the employees as well as the viability and profitability of the HELLENIC POST.

We put an end to the inertia and stagnation that lead to budget deficits and disorganize the HELLENIC POST, undermining the future and prospects of its employees.

The time when Government and Administration were idle onlookers taking no steps to meet the impact of the economic crisis on the HELLENIC POST had to end, and we put an end to it.

With that ends the insecurity and uncertainty caused by rumors, questions, publications and targeted “information” concerning the institutional framework and prospects of the HELLENIC POST and its employees.

Colleagues,

The HELLENIC POST Collective Employment Agreement 2013-2014 is the result of our federation’s fights, assertiveness and plans of action that are steadily oriented towards the protection and expansion of the HELLENIC POST’s employees’ rights as well as the resolution of the HELLENIC POST’s problems.

The first article of the HELLENIC POST Collective Employment Agreement defines the operational framework of the HELLENIC POST and describes the goals and joint actions of its administration and employees.

“The signing of the present Collective Employment Agreement expresses the will of the Administration and the Employees to respect the institutional framework and work jointly and smoothly in order to make the HELLENIC POST a modern, efficient and healthy entity, which will be able to provide high quality services to all citizens of our country. We are well aware of the fact that the HELLENIC POST is trapped within a difficult economic situation, which puts a lot of pressure on the postal services market. The strategic goal of both parties is the viability of the postal organization and the preservation of its profitability using all means available”.

The second article ensures that the institutional framework in force will continue to be protected by Collective Agreements while at the same time being modernized and adapted to the current conditions and needs. P.O.S.T.’s priority is to determine the procedure related to the application of law 4093 in the area of the HELLENIC POST disciplinary law, as the arbitrary interpretation of its provisions by administration officials has resulted in chaotic working conditions.

The third article determines the financial contribution of the employees to the effort of securing the HELLENIC POST’s viability and profitability, which is limited to the suspension of payment of the Christmas, Easter and holiday bonuses for the rest of 2013 and the year 2014.

At this point we should note that not only the wording of this provision but also the graphical representation of the relevant sums leave no doubts as to the time-frame within which it will be in force, thus making it clear that there will be no burden on the colleagues who are about to retire.

The fourth article sheds light on the ambiguities concerning a group of employees, clarifying that the completion of the educational cycles is compulsory for those who wish to participate in the staffing process, provided of course that they meet all other requirements.

The fifth article binds the Administration to take joint action with P.O.S.T. towards the implementation of the investment program included in the National Strategic Reference Framework (NSRF – in Greek ΕΣΠΑ), while at the same time promoting investments of immediate priority and proceeds.

Finally, it is agreed that the provisions of the previous Collective Employment Agreements or any other type of contract are still in force.

Colleagues,

The processes that led to the signing of the HELLENIC POST Collective Employment Agreement has not been simple and smooth; what transpired publicly as well as behind the curtain was unprecedented.

The manipulation, the pressures, the holy alliances and the undermining activity that surrounded it take us back to the Byzantine era.

The political context was and still is hostile. Since September 2012 the Administration has been attempting (following specific orders?) to reduce the salaries cost through salary cuts that would be disastrous for the employees. Their aim was to mitigate the ramifications of the economic crisis as well as of their policies and the only way to achieve that was, once again, through salary cuts.

It is known that, despite this hostility, on many occasions we came close to agreeing upon the text of a Collective Employment Agreement, however, after “outside” or even “inside” interventions, the signing was cancelled at the last moment. The last time that this happened, we published an announcement denouncing these tactics and addressed the HELLENIC POST Executive Board, urging each one of its members, no matter their political background or affiliations, to assume responsibility for their actions.

Colleagues,

It is a fact that the coalition, collaboration and responsible attitude of all political groups, officials and employees resulted in this positive outcome and all the relevant decisions taken have the characteristic that they were supported by everybody, thus the prospect of their implementation is a realistic one.

However, Colleagues,

The signing of the HELLENIC POST Collective Employment Agreement does not mean we should rest assured. The various problems and dangers threatening the HELLENIC POST as well as the conquests of the employees demand that we remain allied and ready to fight.

P.O.S.T. continues its fight on all levels and towards all directions.

Our priorities for the next term are:

·      The planning and completion of the procedures for the hiring of the temporary staff needed for the proper operation of the HELLENIC POST

·     The completion of the take-over of the COURIER SERVICES by the HELLENIC POST and the designing of its function in the most efficient way

·        The securing of the funding of the Universal Postal Service as well as of the social network preservation cost

·     The securing of the postal services contract between the Greek Public Sector and the HELLENIC POST

       The implementation of the various decisions in a steady, coordinated and efficient manner

·        The concerted action for the increase of the profits of the HELLENIC POST through the development of new services, which will create profit-making opportunities, while the profits will balance possible deviations of the program

·       The planning and securing of the HELLENIC POST cash liquidity so as to avoid any accidents and even “deliberate accidents”

·     The completion of the works of the committees provided for in the HELLENIC POST Collective Employment Agreement, giving priority to the area of disciplinary law

·        The setting-up and realization of the regular-leave program

We invite all the employees to keep trying their best and to work together within the trade union movement, as our joint efforts will result in effective fights and courses of action and our sacrifices and contributions will not have been for nothing. In this way, we will be able to safeguard our labor rights and conquests and defend the HELLENIC POST to the benefit of the Greek people and our country.

We keep on fighting, steadily oriented towards our aim, which is the securing of our professional prospects. We remind to everybody that:

The HELLENIC POST COLLECTIVE EMPLOYMENT AGREEMENT 2013-2014 is as follows:

 

HELLENIC POST COLLECTIVE EMPLOYMENT AGREEMENT

In Athens today, on Monday the 10th of June 2013, at 20:00 p.m., at the seat of the HELLENIC POST Administration, 1 Apellou street, the undersigned:

a.   Costis Melachrinos, President of the Managing Board and Managing Director of the Hellenic Post Organization (ΕΛΤΑ), acting as agent of the above institution under the authorization given to him at the 1569/07-06-13 Hellenic Post Executive Board meeting, and

b.     Giorgos Vassilopoulos, President, and Ilias Bakellas, Secretary General of the Executive Committee of the Pan-Hellenic Federation of Postal Associations (ΠΟΣΤ), which is seated in Athens, acting as agents of the above institution under authorization by the P.O.S.T. Managing Board, as evident in the minutes excerpt of its 07/06/2013 meeting, after relevant negotiations, agreed upon and mutually accepted the following:

 

ARTICLE 1

The present Collective Employment Agreement is the first agreement signed after the total liberalization of trade in postal services in our country.

It is evident that the total liberalization of the postal services market is a development of crucial importance for the HELLENIC POST, as its future growth within this framework demands significant changes and decisions.

Given that the HELLENIC POST is an enterprise where the interests of the employer often conflict the interests of the employees, as in every enterprise in the world, it is important to make sure that the forthcoming developments do not occur at the expense of the employees.

The signing of the present Collective Employment Agreement expresses the will of the Administration and the Employees to respect the institutional framework and work jointly and smoothly in order to make the HELLENIC POST a modern, efficient and healthy entity, which will be able to provide high quality services to all citizens of our country. We are well aware of the fact that the HELLENIC POST is trapped within a difficult economic situation, which puts a lot of pressure on the postal services market.

The strategic goal of both parties is the viability of the postal organization and the preservation of its profitability using all means available. For this reason, all bodies of the HELLENIC POST act jointly to achieve the aim of profit-making through two main courses of action: a) increase of proceeds by utilizing all their sources and b) drastic reduction of operational expenses, where necessary.

The present agreement takes into consideration:

a)    The compliance of the Company with the provisions of laws such as 3833/2010, 3845/2010, 3986/2011, 4024/2011 and 4093/2012, that are related to the protection of the national economy, the emergency measures taken against the economic crisis and the implementation of the medium-term budgetary framework for 2013-2015 etc; the compliance with these laws is binding for the HELLENIC POST, which is already implementing them.

b)  The provisions of law 4053/2012, which determines the new institutional framework of the postal services market in Greece, the total liberalization of which from 01.01.2013 will bring significant changes in the area of competition. Within this framework, it is essential to adapt all necessary procedures and functions to the technological developments and the constantly changing needs of the clients.

c)   The significant changes that are taking place in the postal services sector not only globally but also nationally, combined with the great depression of the Greek economy. The continuous downtrend of the bulk mail on an international scale and the increasing use of electronic mail as a substitute as well as the development of the broadband internet in our country are bound to have a significant impact on our activities in the coming years.

d)   The great opportunity to fund new investments in modern technologies and infrastructure through the inclusion of the HELLENIC POST in the National Strategic Reference Framework (ΕΣΠΑ) 2007-2013, which will contribute to the further modernization of the Company’s infrastructure, the reduction of its operational costs, the introduction of new and innovative products and services and, generally, the improvement of the products sold and the services rendered to the clients.

e)   The Overall Reorganization Program that the Company continues to implement in order to achieve administration restructuring, reorganization of the retail, distribution, sorting and transmission network, combined with the necessity to further reduce operational costs on all production and administration levels.

f)     The need to adapt to the constantly changing conditions of the general economy as well as the postal services market with the aim to boost the Company’s extroversion, to adapt all its actions so as to best serve its clients and to provide for mechanisms of immediate adaptation to the implementation of new technologies and the adoption of systems of assessment that will help the Company achieve its goals.

 

ARTICLE 2

CONSTITUTION OF COMMITTEES

Joint Committees of the HELLENIC POST and the P.O.S.T. Federation (ΕΛΤΑ-ΠΟΣΤ) are constituted, with the following objectives:

·        The integration of the binding national laws to the disciplinary rules of the HELLENIC POST.

·        The updating of the work performance regulations for every HELLENIC POST service.

·      The setting up of a motivation system related to the achievement of the company’s goals, within the framework of the operational designing of the HELLENIC POST.

·        The reform of the staffing system in relation to the high responsibility positions in the company.

·        The editing, codification and updating of the provisions of the Collective Employment Agreements that concern the HELLENIC POST personnel as well as of the joint agreements that have been signed until now between the HELLENIC POST and P.O.S.T.

The Committees will consist of HELLENIC POST officials and P.O.S.T. representatives.

The time of completion of the works of the above committees is of one month for the committees responsible for the objectives (a) and (d) and of three months for the other committees, starting from the date of signing of the present agreement.

 

ARTICLE 3

SECURING OF THE PROFITABILITY AND VIABILITY OF THE HELLENIC POST

In order to maintain its presence in the market as well as its effective and efficient operation, the HELLENIC POST is working on a set of measures and actions in relation to the totality of its functions (education, investments, sales, production, quality); all those measures will be integrated in the company’s planning, with the aim to increase profits and reduce expenses.

Therefore:

a) The legal effect of the provisions of article 4 of the HELLENIC POST Personnel Collective Employment Agreement of the years 2006-2007 and the relevant provisions of subsequent Joint Agreements is suspended for as long as the present is in force, with the exception of its earlier re-activation by means of another agreement.

b)  The total sum apportioned every year to the subsidiary “HELLENIC POST Professional Training Center S.A.” (ΚΕΚ-ΕΛΤΑ Α.Ε.) for the implementation of actions related to the education, training, informing, awareness and motivation of the HELLENIC POST personnel, including the programs that are co-funded by the European Union, is reduced from 0,50% to 0,25% of the HELLENIC POST turnover.

c)    The salaries of all HELLENIC POST employees for the months July and December 2013, April, July and December 2014, will be reduced by a sum equivalent to the holiday allowance, Easter bonus and Christmas bonus paid at the above months. This reduction will appear separately from the regular salary, under the indication “HELLENIC POST Collective Employment Agreement 2013-2014”.

 

ARTICLE 4

PERSONNEL TRANSFER

According to article 5 of the 15/12/2011 Joint Agreement signed by the hereby contracting parties, the employees under category A (University Education – Technical Education) who have successfully completed the first cycle of the basic training of the HELLENIC POST Professional Training Center (ΚΕΚ-ΕΛΤΑ) have been transferred to the Administration division 1, with the implicit obligation to successfully complete the remaining three educational cycles.

The employees transferred according to the above paragraph, after their integration in the Administration division 1, they have the obligation to successfully complete the remaining three educational cycles, in order to have the right to participate to the staffing process for the sector and administration responsibility positions.

 

ARTICLE 5

INVESTMENT PROGRAM

The mobilization and joint action of all the HELLENIC POST forces towards the implementation of investments co-funded by the National Strategic Reference Framework (ΕΣΠΑ) 2013-2017 is hereby agreed upon.

At the same time investment programs of high priority and immediate profit-making will be promoted.

 

EFFECT OF HELLENIC POST COLLECTIVE EMPLOYMENT AGREEMENTS ARTICLES

a)    The provisions of previous Collective Employment Agreements and Joint Agreements concerning the HELLENIC POST employees are still in force, as modified or complemented, and form an integrated part of the present to the extent that they do not conflict it.

b)    The present will be in force until 31/12/2014.
