SIGNING OF THE NEW NATIONAL GENERAL COLLECTIVE LABOR AGREEMENT

The negotiations between the Greek General Workers Confederation (in Greek ΓΣΕΕ) and the legal entities representing the employers (the Federation of Greek Industries – ΣΕΒ, the General Confederation of Greek Small Businesses and Trades – ΓΣΕΒΕΕ, the Greek National Confederation of Commerce – ΕΣΕΕ and the Association of Greek Tourism Enterprises – ΣΕΤΕ), concluded yesterday, Wednesday March 26th 2014, with the signing of the new National General Collective Labor Agreement (in Greek: ΕΓΣΣΕ).

The signing of the new National General Collective Labor Agreement (ΕΓΣΣΕ), which was the product of collaboration and mutual consent from both sides, proves that the institution of collective negotiations and collaborative procedures is alive in our country, while at the same time helps secure institutions and established rights that concern the totality of the Greek labor force.

NATIONAL GENERAL COLLECTIVE LABOR AGREEMENT 2014

 

          In Athens today, March 26th 2014, the undersigned:

          a) Dimitrios Daskalopoulos, President of the Federation of Greek Industries (ΣΕΒ) and Hariton Kyriazis, Executive Vice-President and President of the Executive Committee of the same, acting both as representatives of the Federation of Greek Industries (ΣΕΒ),

          b) Georgios Kavathas, President, and Georgios Kourassis, Secretary General of the General Confederation of Greek Small Businesses and Trades (ΓΣΕΒΕΕ), acting as the latter's representatives,

          c) Vasilios Korkidis, President, and Georgios Karanikas, Secretary General of the Greek National Confederation of Commerce (ΕΣΕΕ), acting as the latter's representatives,

          d) Andreas Andreadis, President, and Georgios Vernikos, Secretary General of the Association of Greek Tourist Enterprises (ΣΕΤΕ), acting as the latter's representatives,

and

          Giannis Panagopoulos, President, and Nikolaos Kioutsoukis, Secretary General of the Greek General Workers Confederation (ΓΣΕΕ), acting as the latter's representatives,

all the above legally authorized by their respective organizations to act as their agents,

mutually agree and accept the following:

PREAMBLE

The parties expressly state that they have reached a unanimous and unconditional decision to keep the institution of collective labor agreements alive and to reinstate the role of the National General Collective Labor Agreement (ΕΓΣΣΕ), despite the obstacles posed by the unprecedented for our country recession and the suffocating relevant legal framework, which has imposed severe restrictions on collective autonomy.

The parties hereby reassert their commitment to the implementation of actions that will contribute to the reduction of the exorbitant – for our country – unemployment rates, the elimination of uninsured and undeclared employment as well as the preservation of the after-effect principle, and that will bring back full and universal effect of the National General Collective Labor Agreement (ΕΓΣΣΕ) and the system of extension of collective labor agreements, in order to promote equal treatment of employees and to prevent phenomena of unfair competition between businesses. 

Within this framework, the parties mutually agree to intervene in the designing and implementation of the National Strategic Reference Framework (NSRF) for the Programming Period 2014 – 2020, by signing a National Programming Agreement for the economic and social recovery of Greece and the creation of a collaboration network between them in reference to the following subject matters:

1.     Employment – Education – Vocational Training

2.     Social Welfare

3.     Competitiveness

4.     Entrepreneurship – Innovation         

Finally, the parties agree to consider a proposition for collaboration with the Organization for Employment of the Workforce (in Greek: ΟΑΕΔ), with the aim to coordinate actions related to the employment of youth (e.g.: apprenticeship, training, “youth guarantee” program, youth entrepreneurship etc).

ARTICLE 1

1. The implementation of Joint Actions of the parties is promoted, with technical support by the Athens Office of the International Labor Organization, including the following modules:

a) the mapping of the present situation and the measuring of the effectiveness of the tripartite social dialogue structures,

b) the reinforcement of the procedures and efficacy of the sector-level negotiations,

c) the participation of the parties in the application of quality and viable vocational education and training programs, especially apprenticeship programs, as well as the designing of the proper framework for control and prevention of abusive practices and

d) the combating of discrimination practices within the work place, which are forbidden by law.

2. The parties agree to immediately utilize and promote to the competent state authorities the findings (intermediary and final) of the above Joint Actions, as those will be depicted by the Administration, Quality Control and Policies Processing Work Group, in which all relevant organizations will participate equally.


ARTICLE 2

PARENTAL CHILDCARE LEAVE

(SHORT-TIME EMPLOYMENT) 

The working father has the individual right to parental childcare leave (short-time employment) as provided by the National General Labor Agreements and subject to the same requirements as for the mother. The father is also entitled to parental leave in cases where the mother is self-employed.  

In case both parents are employed persons, they have the right to choose which one of them will make use of the parental childcare leave (short-time employment) in a joint statement addressed to their respective employers. They also have the option to determine, in their joint statement, specific periods of time during which each one of them will make use of the above right, within the total period of time during which their parental leave right is in force.  

The above term enters into force from the signing of the present agreement.

 

ARTICLE 3

The parties decide that all institutional terms of employment that have been legislated by the previous National General Labor Agreements and the respective Arbitration Rulings, as consecutively in force, form a coherent and indivisible whole and are still in effect.

ARTICLE 4 

More concessional terms of employment provided by laws, decrees, ministerial orders, general labor agreements, arbitration rulings, internal rules of procedure, customs, business practices or individual employment agreements, supersede the present.

ARTICLE 5

The parties explicitly agree that, if while the present National General Labor Agreement is in force, any restrictive term forced by law into the text of the National General Labor Agreement 2010-2011-2012 is rescinded in any way, then negotiations related to the determination of salary terms of the National General Labor Agreement will start immediately.

ARTICLE 6 

The present will take effect on January 1st 2014 and will be in force until December 31st 2014, unless otherwise provided. The parties mutually agree that the duration of the present agreement in its present form may be extended for a period of one year.
